Chapter 9: Certification

Regulatory references: 28 CFR 36.601-36.608.

III-9.4000 Preliminary determination.

After receiving the application, the Office of the Assistant Attorney General for Civil Rights will determine whether or not to begin considering the application for certification. If the Assistant Attorney General's office decides to proceed, the office will consult with the Architectural and Transportation Barriers Compliance Board. After that consultation, the office will make a preliminary determination to either --
  1. Find that the code is equivalent (make a "preliminary determination of equivalency"); or
  2. Deny certification.

The next step depends on which of these preliminary determinations is made.
